These terms of service ("Terms") govern your use of our website and any related services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using our website.

Second Story Bags Ltd provides a platform for buying and selling preloved designer handbags bags. These Terms outline the rights and responsibilities of both users and Second Story Bags in relation to the use of our website and the services we offer.

Please read these Terms carefully before using our website. By accessing or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you have any questions or concerns about these Terms, please contact us for clarification. These Terms may be updated or modified from time to time, and it is your responsibility to review them periodically. Continued use of our website after any modifications to these Terms constitutes your acceptance of the updated Terms.

In addition to these Terms, your use of our website is also subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using our website, you consent to the collection and use of your information as described in our Privacy Policy.

All references in these Terms and Conditions to the singular shall include the plural where applicable, and all references to gender shall include both genders and the neuter.

1. Definitions

“% Commission Charge” means the percentage of the Resale Price that Second Story Bags charges for a Consignment Sale.

"Acceptance of Product" means the sooner of the point at which the Buyer provides Written Acceptance or 14 days from Receipt of Product.

“As-is” means the current condition of the Product. 

"Buy" shall mean purchase of any Product by a Customer from Second Story Bags.

"Buyer" means the individual or organisation that Buys or agrees to Buy the Product from the Seller via the website.

 “Checkout” means the secure website Checkout which accepts the order and takes payment.

 "Conditions" means the conditions of sale set out in this document and any special conditions agreed in writing by the Seller.

 “Consignment Sale” means where an item is sold by Second Story Bags on behalf of the Private Seller.

 "Contract" has the meaning as described in Section 4.1.

 “Day” means calendar day.

 “Delivery Carrier” means the company or organisation responsible for the shipment of a Product.

 "Delivery Charge” means the cost to ship a Product.

“Import Duty and Customs Fee” means any payment levied on the import of a Product.

 “Initial Resale Price” means the price at which a Consignment Sale Product is first advertised for sale by Second Story Bags.

"Product" means the physical goods subject to sale by Second Story Bags. 

 "Product Description" means that part of the website where the description of the particular Product is provided.

 “Private Seller” means the individual who has entered into Sole Marketing Agreement with Second Story Bags to allow Second Story Bags to market and sell the Product on their behalf.

 “Purchase Confirmation” has the meaning as described in Section 4.1.4.

 “Receipt of Product" means the point at which the Product is Signed-For on delivery by any individual not limited to the named individual on the invoice. 

 “Resale Price” means the price for which a Consignment Sale Product is currently advertised for sale by Second Story Bags.

“Return” means the Buyer sending the Product back to the Seller.

 ”Second-hand” means the Product has been owned and used previously by another individual  and is therefore not brand new.

 "Seller" means Second Story Bags. 

 "Sender" means the individual sending a Product to Second Story Bags for resale purposes.

“Sole Marketing Agreement” means Second Story Bags has the exclusive right to the Consignment Sale.

 “Sole Marketing Agreement Period” means the 20 week period commencing from the date on which Second Story Bags receives the Product for a Consignment Sale.

 "User" means a person who uses or accesses this Website.

 "Website" means the website www.thesecondstorybags.com and its subdomains.

 “Working Day” means any day other than a Saturday, a Sunday, Christmas Day, Good Friday or a day which is classed as a bank holiday in the United Kingdom.

 “Written Acceptance” means confirmation by way of any form of electronic communication.

2. User Responsibilities

2.1 Users are responsible for providing accurate and up-to-date information when creating an account or engaging in any transactions on our Website. It is essential to ensure that all personal details, including contact information and payment details, are current and valid.

2.2 Users are solely responsible for maintaining the confidentiality of their account credentials, including usernames and passwords. Any activity that occurs under a User's account will be considered their responsibility. It is recommended to use strong and unique passwords and to promptly notify us of any unauthorised access or suspicious activity.

2.3 Users must comply with all applicable laws and regulations when using our website and engaging in any Buying or selling activities. This includes, but is not limited to, adhering to local laws regarding the sale and purchase of preloved designer bags, intellectual property rights, and consumer protection regulations.

2.4 Users are prohibited from engaging in any fraudulent, deceptive, or illegal activities on our website. This includes misrepresenting the condition or authenticity of the designer handbag, engaging in counterfeit or replica sales, or any other activities that violate the rights of others or are contrary to ethical business practices.

2.5 Users are responsible for carefully reviewing and understanding the Terms and Conditions of each transaction, including payment methods, shipping details, and Return policies. It is important to communicate and resolve any concerns or disputes directly with the other party involved in the transaction.

3. Intellectual Property

3.1 All content available on our Website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Second Story Bags or its content suppliers and is protected by intellectual property laws. The compilation of all content on our Website is the exclusive property of Second Story Bags and is protected by copyright laws.

3.2 You may not reproduce, distribute, modify, transmit, display, perform, or create derivative works of any content on our website without prior written permission from Second Story Bags or the respective intellectual property owner. Unauthorised use of any content on our website may violate copyright, trademark, and other applicable laws and could result in legal consequences.

3.3 Second Story Bags respects the intellectual property rights of others and expects our Users to do the same. If you believe that any content on our website infringes upon your intellectual property rights, please contact us promptly with the necessary information to investigate and address the issue.

3.4 The trademarks, service marks, logos, and trade names displayed on our website are registered and unregistered trademarks of Second Story Bags and others. You are prohibited from using any trademarks or logos appearing on our website without the prior written consent of Second Story Bags or the respective trademark owner.

3.5 Second Story Bags may, at its sole discretion, remove or disable access to any content on our Website that is alleged to infringe upon the intellectual property rights of others. In such cases, Second Story Bags may also terminate the accounts of Users who repeatedly infringe upon the intellectual property rights of others.

4. Buying from Second Story Bags

4.1. Conditions 

4.1.1. These Terms and Conditions do not affect your statutory rights as a consumer.

4.1.2. The Terms and Conditions set out in this document shall prevail over any other communication from the Sender or Buyer if not agreed in writing by Second Story Bags prior to Contract.

4.1.3. Confirmation of acceptance of these Terms and Conditions by the Buyer at Checkout shall be deemed conclusive evidence of full acceptance of all the Terms and Conditions.

4.1.4. The Seller confirms acceptance of the Buyer’s order for goods by sending the Buyer an email confirming the order (“Purchase Confirmation”). The contract between Second Story Bags and the Buyer comes into existence when the Seller has sent the Purchase Confirmation following Checkout completion (the “Contract”).  

4.2. Description of Products

4.2.1. If a Product is priced incorrectly on the Website, Second Story Bags is under no obligation to honour it under the Sale of Goods Act. Should this error happen, Second Story Bags will offer the Product at the correct price or refuse the transaction and withdraw the Product from sale until corrected.

4.2.2. The RRP (recommended retail price) is correct as of the time that the Product was consigned to Second Story Bags.

4.2.3. All Products are Second-hand unless specifically stated.

4.2.4. Second Story Bags has the right to end, or amend, a price reduction promotion or competition at any time without any notice.

4.2.5. Occasionally there may be information on Second Story Bags Website containing typographical errors, inaccuracies or omissions that may relate to Product Descriptions, pricing, promotions, offers, Delivery Charges, transit times and availability. Second Story Bags reserves the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or on any related Website is inaccurate at any time without prior notice.

4.3. Prices

4.3.1. Prices on the Website are displayed in pounds Sterling (£ GBP).

4.3.2. The total purchase price, including any Delivery Charges will be displayed on the Website at Checkout.

4.3.3. Prices are non-negotiable.

4.3.4. Payment must be made in full before dispatch of any goods.

4.3.5. Where a deposit is taken up front for a Product, the deposit is non-refundable.  

4.4. Warranty & Liability

4.4.1. All Products are sold As-is and therefore no warranty is given or implied. Products sold described as in a '”New” condition or “As New” remain under the classification of pre-owned. Whilst such Products may still be under manufacturer’s warranty, it is the Buyer’s responsibility to confirm any warranty period prior to Contract. The warranty remains with the manufacturer and not Second Story Bags.

4.4.2. Second Story Bags accepts no liability at any time for defects or issues arising after Acceptance of Product by the Buyer. Under no circumstances shall Second Story Bags be liable for any indirect, incidental or consequential damage. Any personal injury related to the Product at any time is entirely at the Buyer’s own risk. 

4.4.3. Whilst every effort is made to ensure that the Product Descriptions are accurate, the nature of the Product means that the condition can be subject to personal interpretation.

4.4.4. Second Story Bags will endeavour to describe any strong or noticeable odours, however, due to the pre-loved nature of these Products, scents and odours can be perceived differently by individuals.  Second Story Bags cannot guarantee the absence of odours or scents.

4.4.5. Due to the preloved nature of Products, Second Story Bags cannot guarantee the history of any Product and cannot confirm whether a Product has been exposed to an environment where there are pets present. Under no circumstances shall Second Story Bags be liable for any injury or illness as a result of allergies arising from this form of exposure to any Product sold. 

4.5. Delivery

4.5.1. All Products will be shipped via a fully insured, tracked and signed for shipping service within 5 Working Days of payment being cleared.

4.5.2. Second Story Bags shall not be liable for any expenses incurred by the Buyer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date.  

4.5.3. Products purchased will be shipped to the delivery address provided by the Buyer at Checkout.

4.5.4. Tracking details will be provided to the Buyer within 24 hours of the Product being dispatched.

4.6. Non-Receipt

4.6.1. In the event of the non-Receipt of a Product, the Buyer should inform Second Story Bags of non-Receipt within 10 Days following Purchase Confirmation. If after that time 10 the Product has not been delivered and there is no indication of a delivery date from the Delivery Carrier, Second Story Bags will deem the Product to be lost and will file a claim with the Delivery Carrier (Royal Mail) for compensation for the lost Product.  The Buyer will then receive a full refund (inclusive of Delivery Charges) on the earlier of the Delivery Carrier concluding their investigation and providing compensation, or 30 Days following the Purchase Confirmation date.  

4.6.2. In the situation where Delivery Carrier have attempted to deliver a Product and failed, the Delivery Carrier will hold the Product for 18 Days. If a Product is not collected or a redelivery attempted within this time frame, the Product will be returned to Second Story Bags. For any Product returned to Second Story Bags via this method, the Buyer will be given the option of a refund less Delivery Charges plus additional surcharge of £80. If re-delivery is requested, the Buyer will be responsible for the costs of redelivery prior to dispatch of the Product. 

4.7. Customs 

4.7.1. Products that are shipped outside of the UK will have the final purchase amount declared as contents value, as per the enclosed invoice documentation.

4.7.2. Any Import Duties and Custom Fees due are payable by the Buyer directly to the levying country’s custom authorities. Second Story Bags is not responsible for any amounts due.

4.7.3. For any Product returned to Second Story Bags due to the non-payment of Import Duties and Custom Fees, the Buyer will receive a refund less Delivery Charges plus a further surcharge of £80. If re-delivery is requested, the Buyer will be responsible for the costs of re-delivery prior to dispatch of the Product.

4.8. Returns & Refunds

4.8.1. For Consignment Sale Products, Products are sold As-is and Returns are not accepted.  Second Story Bags acts as a sales platform and legal title to the Product does not transfer to Second Story Bags at any point.  As such all sales are on behalf of a Private Seller.  

4.8.2. The Buyer shall inspect the Product within 24 hours of Receipt of Product. In the unlikely event that the Product varied significantly from expected and is assessed not be in acceptable condition due to damage or defect the Buyer must contact Second Story Bags via email at hello@thesecondstorybags.com within 24 hours of Receipt. If the Buyer fails to report any damage or defect during this period, they are deemed to have accepted the goods in the condition received and ownership of the Product then passes to the Buyer.

4.8.3. Any Product in respect of which any claim of defect or damage is made shall be preserved by the Buyer intact together with the original packaging and accompaniments. Photographic evidence of damage or defect must be provided prior to the Buyer sending the Product back to the Seller.

4.8.4 If a Return is agreed by Second Story Bags, the Buyer must Return the Product, (following all written instructions set out by Second Story Bags) for inspection within 24 hours of notification, at their own risk and expense.

4.8.5. Product and accompaniments must be received by Second Story Bags within 5 Working Days of Second Story Bags agreeing to a Return.

4.8.6. On Receipt and inspection, if appropriate, a full refund inclusive of all Delivery Charges incurred will be issued to the Buyer via the original payment method.

4.9 Cancellation

4.9.1. Cancellation instruction from the Buyer must be received by Second Story Bags in writing via email (hello@thesecondstorybags.com) and may take place up to the point at which the Product is dispatched.

4.9.2. Cancellation described in section 4.8.1. does not result in a fee from Second Story Bags, however payments may be subject to a processing fee (deducted at source) which is non-refundable.  Refunds made following a cancellation will be reduced by the third party payment processing fee.  

4.9.3. Once a Product has been dispatched, a cancellation of sale follows the process of a Return per Section 4.8.

5. Consignment Sales 

5.1. Consignment Sales are offered at the discretion of Second Story Bags. No assurance is given that a Product accepted on a consignment basis will sell at the price proposed, at a reduced price, or at all.

5.2. Initial Resale Prices proposed are on the basis of full disclosure of the Product’s condition, smell and accompaniments.

5.3 The Product should be sent to Second Story Bags within 5 Days of Written Acceptance, securely protected, boxed and via an insured, trackable delivery method.

5.4. If the item is not received within 7 Days of Written Acceptance, Second Story Bags reserves the right to cancel the Consignment Sale for the Product.

5.5. By submitting an item for Consignment Sale with Second Story Bags, the Seller guarantees that they are over the age of 16, the item is free from finance or theft, and is guaranteed authentic. 

5.6. Second Story Bags reserves the right to refuse to purchase any Product for any issues relating to stock management, price, authenticity or the financial situation of the company.

5.7. For Consignment Sale Products, ownership remains with the Sender until Receipt of Product has been confirmed by the Buyer.

5.8. If the Product’s condition on Receipt, varies from expected, then Second Story Bags reserves the right to revise the proposed Resale Price appropriately. If the revised Resale Price is not acceptable to the Sender, the Product will be returned to the Sender by fully insured, trackable delivery. The Sender is liable for the Delivery Charges, to be settled prior to the Return of the Product. Second Story Bags will not be liable for any Return Delivery Charge or any other costs incurred associated with the Return of the Product.

5.9. In the unlikely event that a Product received is not deemed as authentic, it will be disposed of and not returned to the Sender. It is a criminal offence to place counterfeit items into the postal service.

5.10. The date of Written Acceptance of the proposed Resale Price constitutes a Sole Marketing Agreement for a period of 20 weeks from that date.

 5.11. If a response is not received from the Sender within 3 Days of proposition of the revised Resale Price, then Second Story Bags assumes the revised Resale Price is accepted by the Sender and will proceed to market the Product on the Website at the revised Resale Price.

5.12. Second Story Bags will endeavour to ensure Products are advertised for sale on the Website within 5 Days of Receipt of Product, however, during busy periods this cannot be guaranteed.

5.13. At any time during the Sole Marketing Agreement Period, the Sender may request the Return of the Product at which point the % Commission Charge based on the Products current Resale Price plus Delivery Charge will be due, prior to the Return of the Product.

5.14. Second Story Bags reserve the right to return the Product to the Sender at any time during the Sole Marketing Agreement Period. If the Return is instigated by Second Story Bags prior to the end of Sole Marketing Agreement Period, Delivery Charges will be borne by Second Story Bags. After the expiry of the Sole Marketing Agreement Period, the Product may be returned to the Sender with the Sender being liable for Delivery Charges prior to the Return of the Product.

5.15. Once the Product is marketed, control over the Resale Price remains with Second Story Bags. Senders may request amendments, however alterations to Resale Price are at the discretion of Second Story Bags.

5.16. If the Product has not sold within 12 weeks from the commencement date of the Sole Marketing Agreement Period, then Sender or Second Story Bags may suggest a price reduction or an alternative marketing approach. The Sender has the right to refuse a price reduction within the Sole Marketing Agreement Period. If the Product has not sold within the Sole Marketing Agreement Period, and a price reduction is not agreed, the Product may be returned to the Sender with the Sender being liable for Delivery Charges prior to the return of the Product.

5.17. After the expiry of the Sole Marketing Agreement Period, if the Product remains unsold, any outstanding amounts owed by the Sender to Second Story Bags must be settled prior to Products being returned, inclusive of Delivery Charges.

5.18. When a sale is realised and the Buyer is in Receipt of the Product, funds will be transferred to the Sender’s nominated bank account within 5 Working Days of the Product being successfully delivered. Second Story Bags will not cover or be liable for any bank charges incurred by the Sender for transfers to a non UK GBP Bank Account.

5.19. Second Story Bags issues payment on the basis of details provided by the Sender and shall not be liable for payment made to the wrong account or to a non-existent account due to incorrect details.

5.20. The Sender will receive the Resale Price less the % Commission Charge, less Delivery Charges, less any payment fees deducted at source as agreed with Second Story Bags at the outset.

5.21. Second Story Bags % Commission Charge is discretionary based on Products Resale Price, desirability and condition of the Product. The standard % Commission Charge varies from 10%-25% of the Product’s Resale Price and is dependent on a Product’s resale value.

5.22. Whilst the Product remains the property of the Sender until confirmation of delivery to the Buyer has occurred, any photographic images or text created by Second Story Bags in relation to the Product, remains the sole property of Second Story Bags and cannot be assigned, reproduced or recreated for any commercial purpose.

5.23. For Consignment Sale Products, ownership remains with the Sender until Receipt of Product has been confirmed by the Buyer.

5.24. Second Story Bags provides insurance cover for loss or damage of a Product whilst in the physical possession of Second Story Bags. Products are insured to their Resale Price less the appropriate commission to be deducted. A further administration charge of £50 to cover the cost of any insurance claim will also be deducted.

5.25. Responsibility for any Product outside of Second Story Bags physical premises transfers to the Delivery Carrier until Acceptance of Product.

6. Competitions

6.1 Introduction

6.1.1. These Terms & Conditions apply to competitions run by Second Story Bags Ltd ("the Promoter"). By purchasing a ticket and entering a competition, you agree to be bound by these terms.  

6.1.2. The Promoter is a company registered in Scotland.

6.1.3. Competitions are conducted in compliance with UK laws, including the Gambling Act 2005.

6.2 Eligibility 

6.2.1.Competitions are open to permanent UK residents aged 18 and over and.   

6.2.2. Employees of Second Story Bags Ltd, their immediate family members, and anyone connected professionally with the competition are not eligible to enter.  

6.2.3. By entering the competitions, you confirm and warrant you are eligible to do so and eligible to claim the prize you may win. The promoter may require you to provide proof you are eligible to enter the competition and claim the prize

6.3 How to Enter

6.3.1. Entry requires the purchase of a ticket via our website. Each ticket purchased will be assigned a unique number.   

6.3.2. Entrants must correctly answer a skill-based question as part of the entry process. Only correct answers will qualify for the random draw.  

6.3.3. The entry fee is stated at the point of purchase and is non-refundable.

6.3.4. The competition will run from the start date to the closing date as stated on the website. Entries received after the closing date will not be counted.  

6.3.5. Qualifying entrants must first create an account via our website. Email address and contact telephone number must be supplied to proceed in the competition. Information provided will be used for notification purposes.

6.3.6. A free competition entry is available. Entries must be sent by First Class or Second-Class Post, handwritten on an unenclosed postcard to the Promoter at the following address: – 50 Merlin Grove, Forfar, Angus DD8 3FJ. One entry per postcard for each competition.  Free entries must include the following information. Exact name of the competition, Full Name, Date of Birth, Address, contact telephone number, email address and answer to the competition question. Incomplete or illegible entries will be disqualified. By entering the competition, you are confirming you are eligible to enter and accept these terms and conditions. Your entry must be received by the promoter prior to the competition closing date.  Entries received after the closing date will not be entered into the draw. Qualifying entrants must have created an account on the website for the free entry to be included. Postal entries received without a registered account will not be processed. All free entries will be treated in the exact same way as paid entries.  Where applicable, these competition terms and conditions also apply to free entries.

 6.4 Winner Selection & Announcement

 6.4.1. The winner will be selected randomly from all eligible entries using a random number generator.  

6.4.2. The draw will be conducted within 48 hours of the competition closing.  

6.4.3. The winner will be notified via email and must respond within 14 days to claim the prize. If the winner does not respond within this period, the prize will be forfeited, and another winner will be selected.  

6.4.4. The winner’s first name and county may be published on our website and social media in line with UK marketing and transparency laws. If the winner objects to this, they must notify the Promoter in writing.  

6.4.5. Winners will be asked to consent to photographs/videos. For those that consent the photographs/videos may be used in future marketing and public relations by the Promoter in conjunction with the competition, identifying them as a winner.

6.5 Prizes & Delivery

6.5.1. The prize will be as stated in the competition details. No cash alternative is available. 

6.5.2. The prize is non-transferable and cannot be exchanged for other products.  

6.5.3. The Promoter will cover the cost of UK delivery. No international shipping is available.  

6.5.4. The Promoter is not responsible for delays or issues with delivery caused by third-party couriers.  

6.6 Refunds & Cancellations

 6.6.1 Entry fees are non-refundable except in cases where the competition is cancelled by the Promoter.  

6.6.2 If a competition is cancelled, all entrants will receive a full refund within 14 days.  

6.7  Fair Play & Disqualification

6.7.1 The Promoter reserves the right to disqualify any entrant who is found to be tampering with the entry process, using multiple accounts, or breaching these terms.  

6.7.2 Automated or bulk entries are prohibited.  

6.8 Limitation of Liability

 6.8.1. The Promoter is not responsible for lost, delayed, or corrupted entries due to technical issues.  In the rare event of duplicate numbers being produced via the ticketing system, any prize won by two or more entrants with a duplicate number will be fully compensated with monetary value of ticket price. The participant who purchased their ticket first will be the participant eligible to receive the prize.

6.8.2. The Promoter’s total liability for any claim arising out of the competition shall not exceed the value of the prize.  

6.9 Data Protection

 6.9.1. Personal data collected for the competition will be processed in accordance with our Privacy Policy and the UK GDPR.  

6.9.2. By entering, you consent to the Promoter using your details for the purpose of administering the competition.  

6.10 Governing Law & Disputes

6.10.1.These Terms & Conditions are governed by the laws of Scotland.  

6.10.2.Any disputes arising from the competition shall be subject to the exclusive jurisdiction of the Scottish courts.

7. Force Majeure 

7.1. In the event that Second Story Bags is prevented from delivering its services as a result of any cause beyond its control such as, but not limited to, Acts of God, War, Strikes, Lockdowns, Illness or Injury, Epidemics, Second Story Bags shall be relieved of its obligations and liabilities to Senders and Buyers for as long as such fulfilment is prevented.

8. Prohibited Activities 

8.1. Users are strictly prohibited from engaging in any fraudulent, deceptive, or illegal activities on our website. This includes, but is not limited to, misrepresenting the condition or authenticity of the preloved designer handbags bags, engaging in counterfeit or replica sales, or any other activities that violate the rights of others or are contrary to ethical business practices.

8.2. Users must not engage in any activity that may infringe upon the intellectual property rights of others. This includes using unauthorised images, trademarks, or copyrighted material in listings or any other content on our website.

8.3. Users are prohibited from engaging in any form of harassment, abuse, or discrimination towards other Users or individuals. This includes, but is not limited to, sending unsolicited messages, posting offensive or inappropriate content, or engaging in any behavior that may create a hostile or uncomfortable environment for others.

8.4. Users must not attempt to gain unauthorised access to our website, interfere with the proper functioning of our website, or engage in any activity that may disrupt or compromise the security of our website or the accounts of other Users.

8.5. Users are prohibited from using our website for any unlawful purposes, including but not limited to money laundering, financing of illegal activities, or any other activities that are in violation of applicable laws and regulations.

 9. Dispute Resolution

9.1. Any disputes or claims arising out of or in connection with the use of our Website or the services provided by Second Story Bags shall be governed by and construed in accordance with the laws of the United Kingdom.

9.2. In the event of any dispute or claim, both parties agree to first attempt to resolve the matter amicably through good-faith negotiations. If the dispute cannot be resolved through negotiations, either party may seek mediation or alternative dispute resolution methods to settle the dispute.
